GUEST LIABILITY
RELEASE OF LIABILITY AND AGREEMENT NOT TO SUE, INDEMNIFICATION, HOLD HARMLESS, LIMITATION OF WARRANTY
We all know that these are uncertain times. The risks of COVID-19 are not well understood and there is controversy among the experts on how the virus can spread and difficulty in scientifically determining whether anyone has the virus at any moment in time.
In consideration for receiving nail care and/or waxing services, you agree to accept all responsibility for the risk that you may contract COVID-19. While we are taking the safety of our guests and that of our staff very serious, by employing new safety and sanitation initiatives, we cannot guarantee that any of these measures will completely protect you from contracting COVID-19.
You agree that if you take any steps to make a claim for damages against M Nails & Spa, its agents, employees or any other released parties arising out of your receipt of nail and waxing services at M Nails & Spa, you shall be obligated to pay all attorneys’ fees and costs incurred as a result of such claim.
Our guests acknowledge that they can go elsewhere to receive nail and waxing services, and acknowledge that M Nails & Spa is not the only nail salon where they can receive these services.​
By receiving services from M Nails & Spa, you acknowledge that you are free to go to other salons who may not require your agreement to accept responsibility for contracting COVID-19 and you chose to receive nail care and/or waxing services at M Nails & Spa.
WAXING DISCLAIMER
The waxing service(s) provided by this salon could have unfavorable results including, but not limited to: allergic reaction, irritation, burning, redness, soreness, etc... Certain medications and over the counter products can significantly increase the risk of injury when combined with skin care services. M Nails & Spa does not recommend skin care services for customers using Retin-A, Acutane and products containing alpha hydroxy, or any other skin thinning treatments. Our guests understand that using any such medications may cause or contribute to such injury/reaction, and should advise their esthetician should they use any such medications. There are often inherent risks associated with skin care services, and as a condition of providing these services on an on going basis, M Nails & Spa shall not be held liable.
